If you do not agree with the terms of this Policy, do not access or use the 精东影业, Websites or any other aspect of 精东影业鈥檚 business.

A separate agreement governs delivery, access and use of the 精东影业 (the 鈥Customer Agreement鈥), including the processing of any files or other content submitted through 精东影业 accounts (collectively, 鈥Customer Data鈥). The organization (e.g., your employer or another entity or person) that entered into the Customer Agreement (鈥Customer鈥 or 鈥Employer鈥) controls their instance of the 精东影业 (their 鈥CustomerZone鈥) and any associated Customer Data. If you have any questions about specific CustomerZone settings and privacy practices, please contact the Customer whose CustomerZone you use.

Information we Collect and Receive

精东影业 may collect and receive Customer Data and other information and data (鈥Other Information鈥) in a variety of ways and in different capacities. For all personal information included in Customer Data, we will be the responsible 鈥渄ata processor,鈥 the party that carries out activities on behalf of the 鈥渄ata controller,鈥 the party who controls the means and purposes of the processing of personal information. When we collect Other Information from you, we will be the data controller.

  • Customer Data. Customers or individuals granted access to a CustomerZone through a Customer (鈥Authorized Users鈥) routinely submit Customer Data to 精东影业 when using the 精东影业.
  • Other Information.聽精东影业 also collects, generates and/or receives Other Information:
    1. CustomerZone and Account Information. To create or update a CustomerZone account, you or your Employer supply 精东影业 with your name, email address, employee ID, hire date, job title, department, line of business and/or similar account details.
    2. Usage Information.
      • 精东影业 Metadata. When an Authorized User interacts with the 精东影业, metadata is generated that provides additional context about the way Authorized Users work. For example, 精东影业 logs activity audit records and usage statistics.
      • Log data. As with most websites and technology services delivered over the Internet, our servers automatically collect information when you access or use our Websites or 精东影业 and record it in log files. This log data may include the Internet Protocol (IP) address, the address of the web page visited before using the Website or 精东影业, browser type and settings, the date and time the 精东影业 were used, information about browser configuration and plugins, language preferences and cookie data. For our Websites personal information collected include name, email address, phone number and information about the organization you work for
      • Device information. 精东影业 collects information about devices accessing the 精东影业, including type of browser or device and what operating system is used.
      • Location information. While using our Websites we receive information from you and other third-parties that helps us approximate your location. We may, for example, use an IP address received from your browser or device to determine approximate location.

Generally, no one is under a statutory or contractual obligation to provide any Customer Data or Other Information (collectively, 鈥Information鈥). However, certain Information is collected automatically and, if some Information, such as CustomerZone setup details, is not provided, we may be unable to provide the 精东影业.

精东影业 does not knowingly collect data from children. If we become aware that data relating to a child has been collected, we will remove it as soon as possible as required by applicable law, and will notify the relevant Customer where that data is held in the 精东影业.

How we Use Information

Customer Data will be used by 精东影业 in accordance with Customer鈥檚 instructions, including any applicable terms in the Customer Agreement and Customer鈥檚 use of 精东影业 functionality, and as required by applicable law. In these respects, 精东影业 is a data processor of Customer Data and Customer is the controller of that data. Customer may, for example, use the 精东影业 to grant and remove access to a CustomerZone, assign roles and configure settings, access, modify, export, share and remove Customer Data and otherwise apply its policies to the 精东影业.

精东影业 uses Other Information it collects in furtherance of our legitimate interests in operating our 精东影业, Websites, and business. More specifically, 精东影业 uses Other Information:

  • To provide, update, maintain and protect our 精东影业, Websites and business.聽This includes use of Other Information to support delivery of the 精东影业 under a Customer Agreement, prevent or address service errors, security or technical issues, analyze and monitor usage, trends and other activities or at an Authorized User鈥檚 request.
  • As required by applicable law, legal process or regulation.
  • To communicate with you by responding to your requests, comments and questions.聽If you contact us, we may use your Other Information to respond.
  • To send emails and other communications.聽We may send you service, technical and other administrative emails, messages and other types of communications. We may also contact you to inform you about changes in our 精东影业, our 精东影业 offerings and important 精东影业-related notices, such as security and fraud notices. These communications are considered part of the 精东影业 and you may not opt out of them. In addition, we sometimes send emails about new product features, promotional communications or other news about 精东影业. These are marketing messages so you can control whether you receive them.
  • In addition, we may contact you about new product features, promotional communications or other news about 精东影业. We will only send you commercial messages if you agree to receive them. You can control this process and have the ability to opt-in to these messages or unsubscribe should you no longer wish to receive any commercial messages from us.
  • We may de-identify and aggregate Other Information.
  • To investigate and help prevent security issues and abuse.

If Information is aggregated or de-identified so it is no longer reasonably associated with an identified or identifiable natural person (that is, no longer considered personal information), 精东影业 may use it for any business purpose.

Data Retention

精东影业 will retain Customer Data in accordance with a Customer鈥檚 instructions, including any applicable terms in the Customer Agreement and Customer鈥檚 use of 精东影业 functionality, and as required by applicable law. 精东影业 may retain Other Information pertaining to you for as long as necessary for the purposes described in this Privacy Policy. This may include keeping your Other Information for the period of time needed for 精东影业 to pursue legitimate business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes and enforce our agreements.

How we Share and Disclose Information

This section describes how 精东影业 may share and disclose Information. Customers determine their own policies and practices for the sharing and disclosure of Information, and 精东影业 does not control how they choose to share or disclose Information.

  • Customer鈥檚 Instructions.聽精东影业 will solely share and disclose Customer Data in accordance with a Customer鈥檚 instructions, including any applicable terms in the Customer Agreement and Customer鈥檚 use of 精东影业 functionality, and in compliance with applicable law and legal process.
  • Customer Access.聽Administrators, Authorized Users and other Customer representatives and personnel may be able to access, modify or restrict access to Other Information. This may include, for example, your employer using 精东影业 features to export logs of CustomerZone activity, or accessing or modifying your profile details.
  • Third Party Service Providers and Partners.聽We may engage third party companies or individuals as service providers or business partners to process Other Information and support our business. These third parties may, for example, provide virtual computing and storage services.We will ensure that any third party processing your information on our behalf does so in compliance with this Policy and applicable law.
  • Corporate Affiliates.聽精东影业 may share Other Information with its corporate affiliates, parents and/or subsidiaries.
  • Aggregated or De-identified Data.聽We may use aggregated or de-identified Other Information for any purpose. For example, we may share aggregated or de-identified Other Information with prospects or partners for business or research purposes, such as telling a prospective 精东影业 customer the average amount of time spent within a typical CustomerZone.
  • To Comply with Laws.聽If we receive a request for information, we may disclose Other Information if we reasonably believe disclosure is in accordance with or required by any applicable law, regulation or legal process.
  • With Consent.聽精东影业 may share Other Information with third parties when we have consent to do so.
  • Mobile Phone Numbers and SMS Consent.聽No mobile phone numbers collected for SMS communications, nor any opt-in consent provided for text messaging, will be shared with or sold to third parties or affiliates for marketing or promotional purposes. All other data sharing categories described in this section exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Information Security

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Data Residency and Global Access – 精东影业

Data protection laws in certain jurisdictions differentiates between the data controller and data processor of information. In the case of the 精东影业 the Customer is the data controller and 精东影业 is the data processor.

Each Customer has a data residency choice to make when the account is established. Currently they can select to have data stored in the US region or in the EU region (Belgium with back-up in the Netherlands).

While the data will be stored as chosen by each Customer based on the above, 精东影业 personnel may access the data from other locations outside of the specified region. The data will continue to reside in the region selected by the Customer.

By accepting this Privacy Policy, or providing us with any personal information, you agree to the above data residency conditions as chosen by your Employer.

Data Residency and Global Access – Websites

精东影业 processes and stores personal information and may use third party providers who may have server(s) based in Canada and the U.S.

If you are located outside of Canada or the U.S, your personal information and other information that we collect through this Website may be transferred to Canada or the U.S, for the purposes described above. 聽By accepting this Privacy Policy, using this Website or providing us with any personal information, you agree to the transfer of information to Canada or the U.S.聽or to the U.S. from Canada, as the case may be.

The Website may contain links to third party websites, plug-ins and applications. Withdrawal of Consent

European Economic Area (EEA) Notice

If you are located in a country in the European Union (EU) and utilize our Websites tools which are offered to EU residents, or if we collect, track, use or process in some other way your personal information collected from you or through your use of our Websites, or we transfer that personal information, we will do so in accordance with this Privacy Policy, and in compliance with applicable requirements of the General Data Protection Regulation (EU 2016/679) (GDPR).

Transfers of Personal Information

For Customer Data, 精东影业 is a data processor and responsible for your personal information, which 精东影业 processes and stores in the region selected by the Customer. Any personal data for which we are the data controller, including 鈥淥ther Information,鈥 will be processed by us and any third parties we engage in this respect. This includes transferring and otherwise processing data outside of the EEA, which will only be done in accordance with this Policy.

The European Commission has decided that Canada ensures an adequate level of protection of individuals鈥 personal information. 精东影业 may use the following safeguards when transferring your personal information to a country, other than the Customers鈥 selected region, that is not within the EEA:

Opt-in

Your Legal Rights

Right to聽request access聽to your personal information (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

No Fee Usually Required

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us to confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). Time Limit to Respond
